These Terms of Service (“Terms”) govern your use of the RoRvsWild monitoring service operated by Base Secrète Sàrl (“we”, “us”, or “our”).

By using RoRvsWild, you agree to these Terms. If you don’t agree, please don’t use our service.

1. The Service

RoRvsWild is a performance monitoring and error tracking service for Ruby on Rails applications. We collect and analyze performance metrics, errors, and related data from your applications to help you identify and resolve issues.

2. Your Account

Account Creation

You must provide accurate, complete, and current information
You must be at least 16 years old to create an account
One person or entity may maintain only one free account
You are responsible for all activity under your account

Account Security

Keep your password and API keys secure
You are responsible for all activities under your account
Notify us immediately of any unauthorized access
We are not liable for losses from unauthorized use of your account

Account Termination

You may close your account at any time by contacting us. We may suspend or terminate your account if you:

Breach these Terms
Use the service fraudulently or illegally
Fail to pay (for paid plans)
Request termination

Upon termination:

Your right to use the service ends immediately
We will delete your monitoring data per our retention policy (30 days)
Invoice data is retained for 7 years for legal compliance
No refunds for unused time (except as stated in our refund policy)

3. Payment and Billing

Free Trial

New accounts receive a 15-day free trial. No credit card required. After the trial period, the monitoring of your applications is automatically suspended unless you add your credit card details.

Paid Plans

Pricing is based on request and job volume as shown on our pricing section
Prices are in EUR
Payment is processed monthly in arrears (beginning of next month for previous month’s usage)
We use Stripe for payment processing

Billing

You will be charged monthly in arrears (at the beginning of the following month)
If payment fails, we will retry and may notify you
After 3 failed payment attempts, your account may be suspended
Update your payment method in your account settings

Price Changes

We may change our prices with 30 days’ notice via email. If you don’t accept the new price, cancel your subscription before the change takes effect.

Refunds

Free trial: No refunds (it’s free)
Paid plans: No refunds for partial months
If we make a billing error, we will correct it and refund you
If we fail to provide the service due to our fault, we will refund the proportional amount

Cancellation

You may cancel anytime. Cancellation takes effect at the end of your current billing period. You retain access until then.

4. Acceptable Use

You may not use RoRvsWild to:

Monitor applications you don’t own or have permission to monitor
Reverse engineer, decompile, or disassemble the service
Interfere with or disrupt the service
Use the service for illegal purposes
Resell or redistribute the service without authorization
Store or transmit malicious code
Violate any applicable laws or regulations

5. Your Data

Data You Send Us

You own all data you send to RoRvsWild
You grant us the right to process this data to provide the service
You are responsible for the legality of data you send us
Don’t send us data you don’t have the right to monitor

Data Filtering: We automatically filter common sensitive fields (passwords, tokens) from error data using Rails’ parameter filtering. However, you are responsible for following security best practices in your application, such as:

Not including sensitive data in URL parameters
Properly configuring parameter filtering for your specific needs
Sanitizing data before it reaches the monitoring layer

Data Processing

If you monitor applications that process personal data, you are the Data Controller and we are the Data Processor
Our data processing practices comply with GDPR
A Data Processing Agreement (DPA) is available upon request
Data is stored in France (EU)

Data Retention

Monitoring data (requests, jobs, errors) is retained for 30 days
After deletion, data is removed from active systems within 24 hours
Backups are overwritten within 30 days
Invoice data is retained for 7 years for legal compliance

Data Security

We implement reasonable security measures to protect your data. However, no system is completely secure. You use the service at your own risk.

6. Intellectual Property

Our Rights

RoRvsWild, our logo, and all related marks are our trademarks
The service, including all software, designs, and content, is owned by us
These Terms don’t grant you any intellectual property rights

Your Rights

You retain all rights to your application code and data
We don’t claim ownership of the data you send us
You may use RoRvsWild branding to indicate you use our service

The RoRvsWild monitoring agent (Ruby gem) is open source:

7. Service Availability

Uptime

We strive to maintain high availability but don’t guarantee 100% uptime. The service is provided “AS IS”.

Maintenance

We may perform scheduled maintenance with advance notice when possible
Emergency maintenance may occur without notice
During maintenance, the service may be unavailable

Documentation is available at rorvswild.com/docs
You can contact us via a form (unregistered visitors), or via email (registered accounts). The link is available at the end of this document and in the footer of the website.
We respond within 48 hours on business days
No phone support is provided

8. Liability and Warranties

Disclaimer

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We don’t guarantee that:

The service will be uninterrupted, secure, or error-free
Results will be accurate or reliable
Errors will be corrected
The service will meet your requirements

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or business opportunities
Service interruptions or data loss
Damages exceeding the amount you paid us in the last 12 months

This limitation applies even if we knew or should have known about the possibility of such damages.

Exceptions

Nothing in these Terms excludes liability for:

Death or personal injury caused by our negligence
Fraud or fraudulent misrepresentation
Any liability that cannot be excluded by law

9. Privacy and Data Protection

Your use of the service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Third-Party Services

Stripe

We use Stripe for payment processing. Your payment information is subject to Stripe’s Terms and Privacy Policy.

Other Services

We may use other third-party services. We are not responsible for their actions or policies.

11. Changes to Terms

We may update these Terms from time to time. If we make material changes:

We will notify you via email at least 30 days before the change
The updated Terms will be posted with a new “Last updated” date
Continued use after changes means you accept the new Terms
If you don’t agree, cancel your account before changes take effect

12. Dispute Resolution

Governing Law

These Terms are governed by the laws of Switzerland, without regard to conflict of law principles.

Jurisdiction

Any disputes shall be resolved in the courts of Geneva, Switzerland. However, we may seek injunctive relief in any jurisdiction.

Informal Resolution

Before filing a claim, please contact us to attempt to resolve the dispute informally. We’ll try to resolve it within 30 days.

13. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us.

Severability

If any provision is found invalid or unenforceable, the remaining provisions remain in effect.

No Waiver

Our failure to enforce any right or provision doesn’t constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.

Force Majeure

We are not liable for delays or failures due to causes beyond our reasonable control (natural disasters, war, pandemics, government actions, etc.).

Survival

Sections that should reasonably survive termination (payment obligations, liability limitations, intellectual property, etc.) will continue to apply.
